That's the theory Vern, but not the reality as far as what the BATF thinks.They draw up a list of what they consider old enough and curious and relic enough and every so often they add to it. Sometimes firearms that weren't OK are now OK. For instance... a P38 pistol, steel frame, a popular German miltary side arm in WWII became C&R probably about the time it became 50 years old. It was surplus from the war years. However, the same pistol , with an aluminum frame , made post war, called a P1 was not C&R for a lot of years until just a few years ago. There are other examples. The 2A and the 2A1 , made in India, Enfields, were like that and the difference was mostly in the way the sights were marked but it took a number of years for both to be considered C&R. There are others.

The list is online but it isn't updated every year.....just whenever they feel like it. And if you look at recent additions, most of them are 100 or more years old when they are added...which seems ... strange.
