Supreme court rules on New York law

Post by Niner » Thu Jun 23, 2022 1:56 pm

Seems New York will have to take a step back in controlling who can apply for a carry permit. Biden all upset about it..... at least for public consumption.
The court’s decision struck down a New York law requiring people to demonstrate a particular need for carrying a gun in order to get a license to carry one in public. The justices said that requirement violates the Second Amendment right to “keep and bear arms.”

Justice Clarence Thomas wrote for the majority that the Constitution protects “an individual’s right to carry a handgun for self-defense outside the home.” That right is not a “second-class right,” Thomas wrote. “We know of no other constitutional right that an individual may exercise only after demonstrating to government officers some special need.”

There are a few states that have followed the New York "reason to own" requirement that a Sheriff or issuing officer can accept or reject in issuing a concealed carry permit . Hawaii is one of those states and with the Supreme Court ruling some are working on more conditions for owning a firearm to offset the new Supreme Court ruling.
The Supreme Court ruling says local governments can’t require those seeking a license to carry a gun in public to demonstrate a particular need, such as a direct threat to their safety. Hawaii and California are among states with such a requirement.

Hawaii police chiefs have issued only four carry permits in the last 22 years, said attorney Alan Beck, who represents George Young, a Big Island man suing to be able to carry a gun for self-defense.

“It’s a huge deal,” Beck said of the ruling. “Not only does it mean Mr. Young’s case will prevail, it also means the door has been opened to challenging numerous aspects of Hawaii firearms law.”

The AP, and other news producers repeating the AP filler. is showing this version of what appears to be a subjective anti gun version of truth right now but presented as objective reporting:
WASHINGTON (AP) — The Supreme Court said Thursday that gun cases involving restrictions in Hawaii, California, New Jersey and Maryland deserve a new look following its major decision in a gun case last week.

In light of last week’s ruling — which said that Americans have a right to carry a gun outside the home — lower courts should take another look at several cases that had been awaiting action by the high court, the court said. Those cases include ones about high-capacity magazines, an assault weapons ban and a state law that limits who can carry a gun outside the home.

The justices, in a 6-3 decision, last week struck down a New York law that required people to show “proper cause,” a specific need to carry a gun, if they wanted to carry a gun in public. Half a dozen states have similar laws that were called into question by the ruling.
"last weeks ruling- which said that Americans have a right to carry a gun outside there home"? The Supreme court only said that New York can't not issue a concealed carry permit based on a judgement of need. It didn't say carry permits were unlawful in states like New York that have them nor that permits couldn't be denied for reasons of mental health or criminal background or other reasons where a person's history suggests he could present a danger to other people or himself.

New York goes nuts and passes some laws that probably won't last very long.
Among other things, the state’s new rules will require people applying for a handgun license to turn over a list of their social media accounts so officials could verify their “character and conduct.”

Applicants will have to show they have “the essential character, temperament and judgment necessary to be entrusted with a weapon and to use it only in a manner that does not endanger oneself and others.”

As part of that assessment, applicants have to turn over a list of social media accounts they’ve maintained in the past three years.

“Sometimes, they’re telegraphing their intent to cause harm to others,” Gov. Kathy Hochul, a Democrat, said at a news conference.

Gun rights advocates and Republican leaders were incensed, saying the legislation not only violated the Second Amendment, but also privacy and free speech rights.
“New Yorkers’ constitutional freedoms were just trampled on,” state Republican Chair Nick Langworthy said.

The bill approved by lawmakers doesn’t specify whether applicants will be required to provide licensing officers with access to private social media accounts not visible to the general public.

People applying for a license to carry a handgun will also have to provide four character references, take 16 hours of firearms safety training plus two hours of practice at a range, undergo periodic background checks and turn over contact information for their spouse, domestic partner or any other adults living in their household.

Here is the latest from California. What the new law actually means is anybodies guess. Wonder if gun sellers have to have crystal ball consultations or need to ask a psychic for a prediction with each gun sale transaction before trading money for a gun? Of course if someone comes in all beat up and raving that he wants to "kill a sonofabitch" I guess that would pretty obviously not be a good sale. But what if someone comes in and says he wants a weapon for protection? Does he have to say if he has someone particularly in mind? What if he doesn't but only expresses a matter of to whom it may concern....is that worse?
SACRAMENTO, Calif. (AP) — Gun makers and dealers in California will be required to block firearms sales to anyone they have “reasonable cause to believe is at substantial risk” of using a gun illegally or of harming themselves or others, under a new law that Gov. Gavin Newsom announced Tuesday that he had signed.

It’s a subjective requirement that goes farther than current background checks or prohibitions on selling guns to people prohibited from owning them.

That is just a blanket "It's not our fault it's the gun makers / sellers" if anyone commits a crime with a gun..........

The Governor of the Republik of California and his fellow morons has also made it easier for the state or anyone
to sue the gun manufacturers, hoping they will go out of business. What an idiot.....
